These Terms form a binding agreement between you and Apna Education and apply to all prospective and current clients, parents or guardians acting for minors, and website users.

1. Scope of Services

Apna Education provides educational counselling and advisory services for admissions to schools, colleges, and universities worldwide, including personalised profile evaluation, program and institution shortlisting, application planning and preparation, document editing and review, interview readiness support, test-timeline guidance, visa guidance and documentation support, and ancillary advisory relating to scholarships, accommodation, and travel when requested. Our services are delivered through in-person consultations, digital communications, and, where applicable, online tools made available via our website. We act as facilitators and advisors; decisions on admissions, scholarships, immigration, or any associated outcomes are made solely by the respective institutions, authorities, and third-party providers.

2. Eligibility

By using our services you represent that you are at least eighteen (18) years of age or, if you are a minor under applicable law, that you have the consent and active involvement of a parent or legal guardian. You affirm that all information you provide is accurate, complete, and truthful, and you agree to promptly update such information if it changes. We may decline or discontinue services if we discover that eligibility criteria are not met or that material information has been withheld or misrepresented.

3. Client Responsibilities

You agree to cooperate in good faith and to provide all information and documents requested by us or reasonably required by universities, testing bodies, visa authorities, or other third parties. You are responsible for the timeliness, accuracy, and completeness of your submissions and for adhering to application and visa timelines, content requirements, and formatting standards. You agree to review drafts carefully, ensure correctness before submission, and comply with any rules, codes of conduct, or eligibility criteria set by third-party institutions and authorities. You further agree to pay all agreed fees on time and to keep your contact details current so that we can communicate deadlines and updates without delay.

4. Fees and Payment

Our professional fees and any applicable taxes will be communicated to you in writing before work begins and must be paid in accordance with the agreed schedule. Unless expressly stated otherwise in a written service agreement, our fees are quoted for advisory and facilitation services only and exclude third-party costs such as test registration, application fees, credential evaluation charges, courier costs, health checks, visa fees, biometric fees, or any other charges levied by universities, government authorities, or service providers, all of which you must pay directly or reimburse where advanced by you or us. Fees are generally non-refundable except as specifically provided in an agreed refund policy or service-specific terms. You authorize us to issue electronic invoices and receipts and acknowledge that late or missed payments may result in suspension or termination of services and, where permitted by law, the application of reasonable late charges or recovery costs.

5. Cancellation and Refunds

You may cancel your engagement by sending a written notice to the contact details provided below. Any refund eligibility, amount, and processing timeline will be governed by the service-specific agreement or refund schedule shared at the time of purchase. Refunds are not available for client-caused issues such as incomplete, inaccurate, or untimely document submissions, missed deadlines, or failure to meet eligibility criteria, and are not available for outcomes outside our control, including rejections by universities, scholarship bodies, or visa authorities. Where a refund is permitted, processing will occur within the time communicated in the applicable agreement after deduction of non-recoverable costs or services already rendered. Cancellation does not affect obligations accrued prior to cancellation, including the payment of outstanding fees.

6. No Guarantee; Limitation of Liability

You acknowledge that admissions and immigration outcomes depend on multiple factors, including institutional criteria, competition, capacity constraints, and regulatory discretion, and that we cannot and do not guarantee admission, funding, visa issuance, timelines, or any particular outcome. To the fullest extent permitted by law, we exclude liability for indirect, incidental, special, punitive, or consequential damages, including lost opportunities, and we are not responsible for delays, losses, or additional costs arising from inaccurate, incomplete, or late information provided by you or from third-party actions or system outages. Our total aggregate liability for any claim related to our services shall not exceed the total professional fees actually paid by you to us for the specific service giving rise to the claim. Nothing in these Terms excludes liability that cannot be limited under applicable law.

7. Intellectual Property

All content, materials, tools, templates, guides, and resources that we create or provide, including the content and design of www.apnaedu.com, are owned by or licensed to apna education and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable licence to use such materials solely for your personal, non-commercial use in connection with your applications and related processes. You must not copy, reproduce, adapt, publish, distribute, display, or create derivative works from our materials without prior written consent. Feedback or suggestions you provide may be used by us freely to improve our services without any obligation to compensate you.

8. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, disclose, transfer, and safeguard personal information in the course of counselling, applications, and visa support. Termination will not affect rights and obligations accrued prior to termination, including payment of outstanding amounts. We will not be responsible for any failure or delay in performance to the extent caused by events beyond our reasonable control, including natural disasters, epidemics, government actions, labour disputes, acts of war or terrorism, civil unrest, widespread technical failures or outages, or disruptions affecting logistics or critical infrastructure. In such circumstances, timelines may be adjusted, services modified, or obligations suspended for the duration of the event.

If the dispute cannot be resolved amicably within a reasonable period, you agree that the matter will be subject to the exclusive jurisdiction of the courts in Indore, India, and that these Terms and any non-contractual obligations arising out of or in connection with them will be governed by the laws of India without regard to conflict-of-laws principles.

Our failure to enforce any right is not a waiver of future enforcement. You may not assign or transfer your rights or obligations under these Terms without our prior written consent; we may assign our rights and obligations in connection with a merger, acquisition, or corporate reorganisation.
